Residência Eletiva - Itália Em que hipóteses a autorização de residência é emitida para residência eletiva? A autorização de residência para residência eletiva pode ser emitida em quatro hipóteses diferentes: a) ao estrangeiro que possui visto de entrada para residência eletiva. Brazilian Senate approves new Migration Law and text goes to presidential sanction.


The Senate plenary today approved (18) the new Migration Law, which will continue to sanction President Michel Temer. The text establishes the rights and duties of the immigrant and visitor, regulates their entry and stay in Brazil and establishes principles and guidelines on public policies for groups.

Among the principles of the law is the guarantee to the immigrant of the status of equality with nationals, the inviolability of the right to life, liberty, equality, security and property and access to public health and education services, as well as Registration of documentation that allows entry into the labor market and right to social security. The immigrant will also be allowed to hold office, employment and public function, as defined in public notice, except those reserved for Brazilian born.

The law criminalizes the actions of traffickers who promote the illegal entry of foreigners into Brazilian territory or of Brazilians in a foreign country, and imposes a fine as a punishment for trafficking in persons for imprisonment of two to five years. The sanction can be aggravated if there is violence. The law also ensures that a foreigner should not be deported or repatriated if there are grounds in the country of origin that put his or her life and personal integrity at risk.

Although the original text of the bill was from the Senate, the subject underwent several changes in the House. On his return to the original House, the proposal was maintained without much change compared to the text approved by the MEPs, but the rapporteur, Senator Tasso Jereissati (PSDB-CE), made some adjustments.

One of them was the withdrawal of an item that includes the protection of the national labor market. According to the senator, "this directive is dubious", because the labor market should not be closed and migration is a factor of its development.

Parts of the original text dealing with the expulsion of the migrant were also kept and had been removed from the House's replacement. In this way, the competent authority shall decide on the expulsion, its duration or suspension, and on the revocation of its effects.

Although approved, some points of the new Migration Law generated controversy among the senators. One of them was criticized by Senator Ronaldo Caiado (DEM-GO), who questioned the passage of the text that guarantees indigenous peoples the right to free movement in traditionally occupied lands, regardless of the boundaries created afterwards. For Caiado, this means "to open the frontiers" of Brazil and can facilitate drug trafficking, especially coming from Venezuela, Colombia and Paraguay.

Tasso Jereissati affirmed that the rights originating from these peoples are guaranteed by the Constitution and that the purpose of the article is to guarantee the circulation to people who are unaware of the border marks fixed by the white man. These groups, according to the rapporteur, can not be embarrassed when moving to hunt or fish, for example.
