Respeitar os preceitos de uma religião é respeitar a dignidade humana. Com este entendimento, o desembargador Paulo Alcides Amaral Salles, do Tribunal de Justiça do Estado de São Paulo, acolheu recurso de um homem que busca o direito de não fazer transfusão de sangue.
O autor da ação é testemunha de Jeová e a religião tem como uma norma não permitir que seus fiéis façam transfusão de sangue. No caso, o homem está com leucemia e a transfusão é o único tratamento. Mesmo assim, ele se recusa a fazer.
O hospital foi à Justiça para obrigar o homem a se tratar. O primeiro grau acolheu o pedido. A decisão de agora do TJ é liminar, sendo que um colegiado ainda irá decidir de forma definitiva.
O relator afirma que apesar do direito à vida ser fundamental, o autor da ação é adulto e capaz e pode decidir. Isso porque respeitar os preceitos religiosos é "expressão da dignidade humana".
"A priori, vislumbro legitimidade na recusa do agravante de se submeter às transfusões de sangue, visto que tal procedimento, para ele, implicaria em tratamento degradante por afrontar as suas crenças". afirma.

The plaintiff is a Jehovah's Witness, and religion has a policy of not allowing its believers to transfuse blood. In this case, the man has leukemia and transfusion is the only treatment. Even so, he refuses to do so.
The hospital went to court to force the man to be treated. The first degree accepted the request. TJ's decision now is a preliminary one, and a board will still make a final decision.
The rapporteur states that while the right to life is fundamental, the plaintiff is adult and capable and can decide. This is because respecting religious precepts is an "expression of human dignity."
"A priori, I see legitimacy in the refusal of the aggravating to submit to blood transfusions, since such a procedure, for him, would imply degrading treatment for affronting his beliefs." affirms.
